Sewers
Section 104 and Section 106 of the Water Industry Act 1991 both relate to sewer connections and adoption, but they serve different purposes.
- Section 104 agreements are for the adoption of newly built sewers and pumping stations by the local water company, meaning the company takes over responsibility for their maintenance.
- Section 106 deals with the right to connect to existing public sewers, granting developers the ability to discharge wastewater from their properties or developments into the public system
Highways
- A Section 38 agreement, governed by the Highways Act 1980, is a legal agreement between a developer and a local highway authority in the UK. It ensures that new roads built by the developer will be constructed to a standard acceptable for adoption as public highways. Essentially, it's a way for developers to get new roads they build adopted by the council, making them maintainable public roads.
- Section 278 Agreement (Highways) - enabling a contractor to carry out works on the existing public highway.
